**General Terms and Conditions of Sale**
**PREAMBLE**
These general terms and conditions of sale are those of CHERIGAN PARIS, a limited liability company with a capital of €30,918.78, whose registered office is at 37 rue Louise Weiss, 75013 PARIS, FRANCE, registered with the Paris Trade and Companies Register (RCS) under number B 900 364 514, VAT number FR29900364514.

These general terms and conditions of sale apply to any sale of products made to individuals (hereinafter referred to as the "Consumer") via the website www.cheriganparis.com or its derivative addresses (hereinafter referred to as the "Site").
CHERIGAN PARIS offers for sale to Consumers browsing the Site various products including perfumery, personal hygiene products, and fragrance diffusers (hereinafter referred to as the "Products"). It is specified that the Products are intended exclusively for personal use by the Consumer and cannot be purchased for resale.
These conditions are not intended to deprive consumers in the European Union of the mandatory legal provisions provided by the legislation of their own country. If one of the provisions of these conditions proves to be contrary to mandatory legal rules that the Consumer could benefit from under their national legislation, this provision will not be applicable to that Consumer, with all other provisions remaining valid.
The Consumer's consultation of the Site is also governed by the Site's terms of use, which the Consumer accepts without reservation.
For the application of these terms, it is agreed that the Consumer and CHERIGAN PARIS will be collectively referred to as the "Parties" and individually referred to as a "Party".
**ARTICLE 1: SCOPE**
These General Terms and Conditions of Sale define the terms of sale of CHERIGAN PARIS Products to the Consumer, as well as the rights and obligations of the Parties arising from the sale of Products offered on the Site www.cheriganparis.com.
CHERIGAN PARIS may update these General Terms and Conditions of Sale at any time without notice, which can be consulted by the Consumer at any time. These General Terms and Conditions of Sale govern without restriction the sales of Products made on the CHERIGAN PARIS online store.
By placing an order for a Product on the Site, the Consumer acknowledges having read and accepted these General Terms and Conditions of Sale without restriction. These General Terms and Conditions of Sale may be subject to subsequent modifications, and the applicable version to the Client's purchase is the one in effect on the site at the date of the order. This acceptance is in no way conditioned by a handwritten signature from the Consumer. It is specified that the Consumer can save or print these General Terms and Conditions of Sale, provided they do not modify them.
**ARTICLE 2: PRODUCTS**
**2.1 Description of Products**
CHERIGAN PARIS presents the Products for sale on the Site along with their detailed descriptions on the product pages.
**2.2 Availability**
CHERIGAN PARIS reserves the right to modify or discontinue the sale of Products offered on the Site at any time, with such modifications not affecting orders that CHERIGAN PARIS has accepted before the entry into force of these modifications.
Each product page indicates the availability time for dispatch of the order. If, however, a Product is unexpectedly out of stock, delaying the dispatch of the order, an informative email will be sent to the Consumer.
**2.3 Prices**
**2.3.1** All product prices are indicated in Euros, including applicable VAT for delivery in France. The applicable prices are those indicated on the Site at the time the Consumer places their order, after any adjustments of VAT automatically applied following the indication of the order's destination country, except for typographical errors. Product prices exclude delivery costs, which are added to the order total on the "Cart" page. Customs duties are not included in the product prices or in the order total and may be due upon delivery according to local regulations.
**2.3.2** CHERIGAN PARIS reserves the right to modify its prices at any time without notice. These modifications will not affect orders that CHERIGAN PARIS has accepted before the entry into force of these modifications, subject to the availability of the ordered Products. Product offers are valid as long as they are visible on the site, within the limit of available stocks.
**ARTICLE 3: ORDER**
**3.1 Ordering Procedure**
While browsing the Site, the Consumer can view the Products offered for sale on the day of the Site consultation. Browsing the various pages of the Site does not obligate the Consumer to place an order. The selection and purchase of a Product is the sole responsibility of the Consumer.
During navigation on the Site, the Consumer wishing to place an order can do so by simply clicking on the "Add to cart" icon located below the product description. By default, the quantity mentioned is 1. If the desired quantity to order is greater than 1 unit, the Consumer can manually modify the quantity.
The Consumer can view their order by clicking on the cart icon in the top right corner and can at any time complete, modify, or cancel it before the actual payment step. On this same page, the Consumer can get an estimate of delivery costs.
Once the selection of Products is complete, the Consumer can order them by clicking on "Checkout". A new web page will then open, inviting the Consumer to identify themselves or create an account. The Consumer must provide their details by accurately filling out the provided form and then choose the desired delivery method.
The Consumer must verify all information related to their order before selecting a payment method and accepting the General Terms and Conditions of Sale before confirming and proceeding with payment for their order.
The data recorded by CHERIGAN PARIS constitutes proof of all transactions between CHERIGAN PARIS and the Consumer.
**3.2 Order Confirmation**
**3.2.1** Once these General Terms and Conditions of Sale are accepted and full payment validated, an order summary that can be printed and saved will appear, indicating the order references.
The Consumer will receive a confirmation email detailing their order placed on the Site www.cheriganparis.com.
**3.2.2** CHERIGAN PARIS retains ownership of the ordered products until full payment of the price and its accessories, including shipping costs.
**3.2.3** To protect CHERIGAN PARIS from abusive, fraudulent, or non-compliant practices with its distribution networks, if CHERIGAN PARIS suspects such practices during an order, it reserves the right to request additional documents from the Consumer (proof of address and debit in the name of the Consumer, photocopy of the Consumer's ID card, photocopy of the Consumer's bank card, or other) to rule out suspicion of such practices.
If the Consumer does not respond within fifteen (15) days following the request from CHERIGAN PARIS, the order will be canceled and CHERIGAN PARIS will promptly refund it to the bank account debited during the order.
**3.3 Proof of Order**
By express agreement between CHERIGAN PARIS and the Consumer, emails will be considered as proof between the Parties as well as the automatic registration systems on the Site, particularly regarding the nature of the order.
The Consumer can access the electronic contract concluded with CHERIGAN PARIS, if applicable according to common law rules, by contacting Customer Service via email at info@cheriganparis.com and providing all necessary information, including the order number and their contact details.
**ARTICLE 4: PAYMENT**
**4.1** Payment must be made online at the time of the order in Euros by credit card or PayPal. Payment by credit card must be authenticated by a 3D Secure code.
Orders are processed upon receipt of full payment from the Consumer. If the order is paid by credit card or PayPal, the order will be validated the next business day.
**4.2** CHERIGAN PARIS reserves the right to refuse any order or delivery in case of an existing dispute with the Consumer, total or partial non-payment of a previous order by the Consumer, refusal of credit card payment authorization by banking organizations, non-payment or partial payment.
**4.3** The Consumer guarantees CHERIGAN PARIS any necessary authorizations for using the chosen payment method at the time of order validation. In case of refusal by the bank, the order will be automatically canceled.
**4.4** CHERIGAN PARIS uses the Stripe payment platform.
**ARTICLE 5: DELIVERY**
**5.1 Delivery Methods**
Products ordered by the Consumer will be delivered to the postal address provided by the Consumer during their online order, either by Postal Services or another transport company.
The Consumer can track their delivery progress on the Site by clicking on "My account" and entering their email address and password provided during their order.
In case of Consumer's absence, the carrier will leave a delivery notice in the Consumer's mailbox. The Consumer must then contact the carrier to arrange a new delivery date. However, if
the Consumer does not arrange a new delivery within the specified time, the package will be returned to CHERIGAN PARIS.
**5.2 Delivery Deadlines**
Delivery will take place no later than 30 days following the order placement unless otherwise specified during the order process. In case of non-compliance with this deadline, the Consumer can cancel the order.
**5.3 Delivery Charges**
Delivery charges are indicated to the Consumer on the summary page before order confirmation.
***5.4. Receipt**
Each delivery is considered completed upon the availability of the Product(s) to the Consumer by the carrier, as evidenced by the control system used by the carrier.
It is the Consumer’s responsibility to immediately verify the conformity and integrity of the Product(s) at the time of receipt.
In case of delay, breakage, or missing items, the Consumer must make complete and precise reservations on the delivery slip. In any case, the Consumer can only exercise recourse against the carrier, to whom they must make their reservations. Any reservation must be confirmed by registered letter to the carrier within three (3) days following receipt.
Such reservations must also be notified to CHERIGAN PARIS Customer Service within the same period and in the same form at the following address: CHERIGAN PARIS Customer Service Internet 37-39 rue Louise Weiss, PARIS, France, or by email at: info@cheriganparis.com. A copy of the complaint sent to the carrier must be attached.
Any claim made after this period or without respecting the required form will be rejected, and CHERIGAN PARIS will be released from all liability.
**ARTICLE 6: RIGHT OF WITHDRAWAL**
The Consumer has a right of withdrawal period of fourteen (14) days from the receipt of the Product(s) by the Consumer. In the case of an order including different items delivered at different times, the fourteen (14) day period will run from the receipt of the last Product.
In this case, the Consumer must send their request by email to info@cheriganparis.com and must return the complete Product(s), in perfect condition, unopened, and in their original packaging accompanied by a copy of the return slip to the address indicated on the return slip.
The right of withdrawal cannot be exercised for personal hygiene products (Velouté de Douche, Émulsion Exquise, and soaps).
Return costs are the responsibility of the Consumer unless there is an error from CHERIGAN PARIS. In this latter case, CHERIGAN PARIS will send a Colissimo label to the Consumer or refund the return costs.
If the Consumer withdraws from the entire order, CHERIGAN PARIS must refund all amounts paid, except for delivery costs. CHERIGAN PARIS is not required to refund additional delivery costs when the Consumer has chosen an express delivery method, which is more expensive than the standard delivery method.
CHERIGAN PARIS commits to refund the Consumer using the same payment method initially used, within a maximum period of fourteen (14) days from the date of the withdrawal request, subject to compliance with the above-mentioned conditions.
In case of return of the Product(s) after the above-mentioned period, the Consumer will not be refunded. The Product(s) can be reshipped at the Consumer's expense.
**ARTICLE 7: CONFORMITY AND WARRANTY OF PRODUCTS**
The Products are subject to the conditions and warranties provided by French law.
CHERIGAN PARIS, as a professional seller, guarantees that the Products conform to the expected use and do not present any defects or hidden flaws that would make them dangerous or unsuitable for their normal use.
Furthermore, for any non-conforming Product, the Consumer must contact CHERIGAN PARIS Customer Service Internet by mail at 37-39 rue Louise Weiss, PARIS, France, or by email at info@cheriganparis.com.
The Customer Service will then inform the Consumer of the procedure to follow.
The Products must be returned in their original condition and packaging with the product return form within fourteen (14) days from the receipt of the Product(s) by the Consumer.
CHERIGAN PARIS does not accept parcels sent postage due.
Any risk related to the return of the Product(s) is the responsibility of the Consumer.
Upon receipt of the presumed non-conforming Product(s), CHERIGAN PARIS will conduct an inspection of the Product(s) as soon as possible. If the non-conformity of the Product(s) is confirmed, CHERIGAN PARIS will proceed with the refund (including initial delivery costs) to the account debited during the order, of the non-conforming Product(s) within fourteen (14) days from the date of the withdrawal request, subject to compliance with the above-mentioned conditions.
**ARTICLE 8: LIABILITY**
CHERIGAN PARIS cannot be held liable for any inconvenience or damage inherent to the use of the Internet, including service interruption, external intrusion, or computer viruses.
Without limiting the scope of the preceding provisions, CHERIGAN PARIS’s liability under these terms cannot exceed an amount equal to the amounts paid or payable during the transaction giving rise to such liability, regardless of the cause or form of the action concerned.
CHERIGAN PARIS is not responsible for failure to fulfill its obligations as defined in these terms due to an act of God or force majeure.
**ARTICLE 9: LEGAL NOTICES AND LEGAL CLAUSES**
**9.1. Data Protection**
The provision of personal information collected for distance selling is mandatory, as this information is necessary for processing and delivering orders and issuing invoices. This information is strictly confidential and will only be used by CHERIGAN PARIS or its subcontractors, who are subject to the same obligations, for the processing of orders.
In accordance with Law No. 78-17 of January 6, 1978, relating to information technology, files, and freedoms, the Consumer has the right to access, modify, rectify, and delete personal information collected by CHERIGAN PARIS concerning them.
To exercise this right, the Consumer can choose to send an email to CHERIGAN PARIS Customer Service at info@cheriganparis.com or send a postal letter to the following address: CHERIGAN PARIS Customer Service Internet 37-39 rue Louise Weiss, PARIS, France.
CHERIGAN PARIS commits not to resell the Consumer’s contact details to third-party companies without their prior consent.
The Consumer may receive information emails about CHERIGAN PARIS products and activities. The Consumer retains the possibility to refuse such communication by not giving their consent at the time of order validation or by expressing their refusal by email to info@cheriganparis.com or by mail to the following address: CHERIGAN PARIS Customer Service Internet 37-39 rue Louise Weiss, PARIS, France.
**9.2. Force Majeure**
No Party shall be held responsible for the non-fulfillment of its obligations if this non-fulfillment is due to an unforeseen event or the occurrence of an element constituting force majeure such as, and without this list being exhaustive, flood, fire, storm, lack of raw materials, transport strike, partial or total strike, or lockout. The Party affected by such events must inform the other party as soon as possible and no later than five (5) working days after the occurrence of this event.
The Parties agree to consult each other as soon as possible to determine the terms of order execution during the period of force majeure.
If the force majeure event lasts longer than one (1) month, CHERIGAN PARIS may not honor the order, and CHERIGAN PARIS will refund the Consumer for the amounts paid for the order concerned, if applicable.
**9.3. Partial Invalidity**
If one or more stipulations of these general terms and conditions of sale are deemed invalid or declared as such pursuant to a law, regulation, or following a final decision of a competent court, the other stipulations will retain their full force and scope.
**9.4. Modifications to the General Terms and Conditions of Sale**
CHERIGAN PARIS reserves the right to modify these general terms and conditions of sale. Any new version of these will be indicated on the Site.
The online version on the Site will prevail, if applicable, over any other version of these general terms and conditions of sale.
**9.5. Entire Agreement**
These general terms and conditions of sale and the order summary transmitted to the Consumer form a contractual whole and constitute the entire contractual relationship between the Parties.
**9.6. Cookies**
CHERIGAN PARIS may place a cookie on the Consumer's computer during their navigation on the Site. This cookie allows CHERIGAN PARIS to record information related to the navigation of the Consumer's computer on the Site (pages viewed, date and time of viewing, etc.) and also aims to provide navigation comfort and site usage, notably by personalizing certain pages. The Consumer can oppose the recording of cookies by configuring their browser accordingly.
**9.7. Applicable Law - Disputes**
The law applicable to these general terms and conditions of sale and the related sales is French law.
Any dispute that may arise regarding their validity, interpretation, or execution and that has not been settled amicably by the Parties will be submitted to the courts of Paris or the courts whose jurisdiction will be determined by the application of common law.
